The Planning and Compulsory Purchase Act 2004

Business pictureAs many of you are aware, the first new Planning Act for over a decade is now in full force, the final Part 3 of the Act in relation to Development Plans was brought into effect as of 28th September 2004.

One may be forgiven for thinking of the old adage: “. . . if it ain’t broke don’t fix it!”

Whilst there is consensus that there are probably faults with the present legislation dating from 1990, the reality is that these have possibly more to do with the lack of adequate resources made available to the Local Planning Authorities rather than any real need for considerable amendment to the existing legislation, with little in the way of further resources!
We shall see . . .
