Effective Date of Termination

An employee was told that she could not return to her job on 1st September 2015. She was then purportedly placed on garden leave three days later and on 29th September she was purportedly given notice that her employment would terminate on 23rd October.

The EAT held that her effective date of termination was 1st September when she was effectively dismissed without notice. The subsequent attempts to put her on garden leave and give her notice were therefore of no legal effect.
