Non Execs Liable

Two non-executive directors, who were instrumental in dismissing the Chief Executive of International Petroleum Ltd following whistleblowing allegations by him, were jointly and severally liable with the Company for £1,774,575.56 of losses suffered by the Chief Executive.

The President of the EAT, Mrs Justice Simler, held that it was unusual for a former employee to bring a claim against individual workers in addition to the Company but there was no reason in principle why such a claim could not be brought against individual workers under the whistleblowing legislation.
